From the "Comments" section: If he makes the appointment during a recess of the next congress (112th), when congress returns, a confirmation hearing will be called and the likelihood of him being confirmed is slim to none.--Chris GRE

I am not a Constitutional scholar, but the following contradicts the assertion made by Chris GRE:

From the Congressional Research Service--Recess Appointments: Frequently Asked Questions

How long does a recess appointment last?

"A recess appointment expires at the end of the Senate's next session or when an individual (either the recess appointee or some one else) is nominated, confirmed and permanently appointed to the position, which ever occurs first. In practice, this means that a recess appointment COULD LAST FOR ALMOST TWO YEARS [emphasis added]."

Obama is too shrewd to gamble a blue chip for short-term benefits. Schumer-Traver is the hinge on which Obama's fortunes now turn. We are in for a difficult two years--but if we close ranks, so is Obambi. ;^)
