Even so-called good cops had a major beef with people who insisted on their rights, 30-40 years ago just as they do today.

Noncompliance must be punished, in the mind of the authoritarian douche bag. Absolutely must be punished, more so than actual lawbreakers must be punished.

That's the kind of guy who is not qualified to be in law enforcement. Pull a weapon on an unarmed guy standing in front of his house? In Texas, 'LEO' or not, a person approaching with a weapon in an intimidating manner becomes a justified target. They need to get this cop off the street, take his gun and badge and order him in for a psych evaluation.

People who misuse the powers of their office are actual lawbreakers. But expecting many of them to be punished is about as reasonable as expecting Congress, some of the richest people in the USA, to do anything substantial against "the 1%".

Uh, correct me if I am wrong but doesn't this officer close the distance between him and the cameraman unwisely and against the safety protocol the police talk about all the time? He was rather close before pulling out his gun (knife range?), which seems to indicate he wasn't that afraid of a violent threat but perhaps, wanting to intimidate?

Always with the Nazi's. The funny thing is, in Germany today, as long as you are not hurting anyone, the police pretty much ignore you. If, however, are acting like feral ape, they will crush your soul. Count on it.

Here is a scenario: a few weeks ago I am walking with my family through one of the biggest city festivals in the country, drinking an open cup of home brewed beer with a pocket full of pot seeds given to me by the local Pirate Party. Not that I smoke that crap, but hell, why not? No cops in sight. No jackasses causing problems. No malum prohibitum. Just folk’s spending money and having a good time.

Not that Germany is the bastion of civil liberty. Far from it when people are taxed into slavery and are not afforded the most basic human right to their own self defense. But they do have a few things right. One of which is a highly trained police force with a non-combative relationship with their employers. Another I would say is an absolute right to privacy. I am sure you can guess as to why the Germans take these things seriously.

Once the dust settles in the States after the inevitable Balkanization, maybe whatever remains of cops can have the same benefit of hindsight. Until then, you will have to deal with the Officer Friendlies out there whom solely gets their information about the world from George Takei's facebook site, MSNBC and the Daily Show.

Texas Penal Code Section 9.4 says that if force is justified then THREAT of deadly force does not constitute USE of deadly force if the intent of the person threatening deadly force was merely to make the person threatened concerned. What that means is that I can threaten to shoot you if I tell you to leave my property and you refuse. Since force is justified (I am allowed to tell you to leave and voice is a level of the force continuum), my threatening to shoot you does not constitute use of deadly force.

If force is NOT justified then the threat of deadly force CONSTITUTES USE of deadly force! Drawing down on someone is unequivocally a threat of deadly force. Since the man videoing the pig was clearly not engaged in any unlawful activity, there was no justification for the LEO to even stop his car and get out - much less draw down on the guy shooting the video. In that case the pig arguably committed aggravated assault - more there is a clear record in color and sound. If the guy taking the video were Mike's or my age (60+) then the severity of the crime (in Texas, at least, can't say about Bama) would automatically increase one degree of felony to 1st degree - i.e. 5 - 99 or life. (If somebody hits me and I bruise its AT LEAST worth a year in TDC).

Sad fact is this moke likely won't get more than a butterfly wing tap on the wrist.

The very fact that this "officer" used the term "Constitutionalist crazy guy" shows the indoctrination of the LE community by the likes of the SPLC and their biased, tainted reports on "domestic terrorists" being white people who espouse ideals of liberty inline with those of the Founders. How dare this uppity citizen exercise his 4th Amendment rights as well as his right to film an officer in public! The nerve!
