"Mental Illness" was the penumbra under which the Soviet Union simply jailed dissidents. No one was ever "adjudicated" or ever seen by a psychiatrist except to merely rubber stamp the already determined diagnosis of a mental illness. We can ill afford allowing a state to just determine on their own what constitutes mental illness to the degree the person's rights can be waived without due process.
