Kurt Hofmann: Illinois lawmakers pondering gun ban in defiance of voters' will

The NRA reports that, with Governor Pat Quinn cheering them on, Illinois legislators might try to ban so-called "assault weapons" (and, given Quinn's involvement, presumably "high capacity" magazines, and .50 caliber firearms and ammunition, as well) over the course of the coming week (the last week of the session).

Prudence, indeed, will dictate that Governments long established should not be changed for light and transient causes; and accordingly all experience hath shewn, that mankind are more disposed to suffer, while evils are sufferable, than to right themselves by abolishing the forms to which they are accustomed. But when a long train of abuses and usurpations, pursuing invariably the same Object evinces a design to reduce them under absolute Despotism, it is their right, it is their duty, to throw off such Government, and to provide new Guards for their future security.-- Declaration of Independence

Given the Heller and MacDonald U.S. Supreme Court decisions, and the recent Moore v. Madigan and the Shepard v. Madigan decisions by the U.S. Court of Appeals for the Seventh Circuit (Chicago), the sooner the the Illinois Legislature passes legislation, the sooner the law will be declared unconstitutional:

If the Illinois Legislature can work this quickly, then Judge Posner made a mistake giving them 180 days.

Donald Kaul : Repeal the Second Amendment, the part about guns anyway. It’s badly written, confusing and more trouble than it’s worth. It offers an absolute right to gun ownership, but it puts it in the context of the need for a “well-regulated militia.” We don’t make our militia bring their own guns to battles. And surely the Founders couldn’t have envisioned weapons like those used in the Newtown shooting when they guaranteed gun rights. Owning a gun should be a privilege, not a right.
Declare the NRA a terrorist organization and make membership illegal. Hey! We did it to the Communist Party, and the NRA has led to the deaths of more of us than American Commies ever did. (I would also raze the organization’s headquarters, clear the rubble and salt the earth, but that’s optional.) Make ownership of unlicensed assault rifles a felony. If some people refused to give up their guns, that “prying the guns from their cold, dead hands” thing works for me.

It's sad that honest intentioned people don't realize the actual basis of the 2nd Amendment as it can be readily, and easily understood by reading the discussions regarding it during the formation of the Constitution -- Federalist #29 is especially lucid and enlightening. The 2nd Amendment was not to provide sportsman fun target shooting, hunting Bambi or Donald Duck; if fact, it really isn't about self defense only against criminal elements in society. It's for self defense against a criminal, tyrannical government. The first thing every dictatorial society did before exerting total control of it's subjects -- and that's what unarmed, defenseless citizens are, subjects -- was to disarm them, usually on the faux premise of security and safety for the subjects.

As Thomas Jefferson noted at the time, "The beauty of the Second Amendment is that it will not be needed until they try to take it."

Or, as another fervent advocate of gun control said: " “This year will go down in history. For the first time, a civilised nation has full gun registration! Our streets will be safer, our police more efficient, and the world will follow our lead into the future!” Adolf Hitler

Yeah, they almost made membership in the Communist Party illegal. However, it was a guise in order to whitewash the ill thought of commies, to cleanse their image by moving them into the Democratic Party with a new veneer. Instant new and "positive" identification striving for the same goal as always -- subjugation and control of all subjects living in the United States under communist control. Obviously it worked as they have millions of useful idiots like Kaul spouting their supposed glory and actively working to make it happen...freakin' idiots.
