I still hold that a third gun was involved, as was mentioned by Hope MacAllister. Too bad there isn't enough evidence to sue the FBI for another $25 million. They need a black eye in this as much as the ATF. The fact that Brian Terry's family is dealing with some of the worst scum our Republic has to offer; the amount is way too low.

This represents yet another front in the slow and sedate assault on fast and furious.

Needed to add Burke to the suit as well for lying to them in an official capacity. Burke would than have two defenses (A) I was a US Attorney and can do anything I want to (which might not do well in front of a jury), or (B) I was acting at the direction of my superiors as the immunity for official acts defense.

While I am glad that the ATF is getting slammed with a lawsuit, remember that their pay out will be with OUR tax dollars, not their own money.

I want a pound of flesh carved from the blubber of Holder's ass over this.

And it's been filed over the Fast and Furious ale of the rifles used the night of his killing? Why not file against the FBI for keeping it a SECRET that drug dealers/runners were KNOWN to be in Peck Canyon that night. For failing to INFORM the Border PAtrol. For having an FBI informant LEADING the damned drug runners through the canyon??!!! The FBI is DIRECTLY responsible for the death of Brian Terry. Is that part of the suit?

This lawsuit will effectively put Lone Wolf out of business and the ATF will skate...mark my words.

Given the most probable outcome of "Lone Wolf Trading" being hung out to dry by ATF, I wonder what effect this will have on relations between the rest of the FFL community and ATF? Somewhat less cordial and willing co-operation in the future?

I assume Lone Wolf is the dealer where the walked guns started their journey.

My belief is that any dealer that participated in Fast and Furious should be arrested, sued, jailed, flogged, etc. for their participation. They broke the law, too.

One thought comes to mind. This will be a civil trial for damages as opposed to a criminal trial seeking to prove guilt or innocence of an accused. As a result, the rules of evidence and discovery are quite different. We may get to see some additional and more enlightening details of Fast and Furious as a result. If any of you readers are of the lawyer persuasion, perhaps you could comment on what we might expect.
