Robert Pratt of Pratt on Texas discussed this recently in one of his Anti-Wimp Updates. The armed citizen brandished the weapon, but didn't menace anyone with it, so he did absolutely nothing wrong under Texas State law. Even if he had pointed it at the assailant, threatening only the assailant, he would still be in the right. I think. The brandishing law still seems a bit fuzzy to me, with a lot of police and prosecutorial discretion in it, but that's how it is.

The bottom line is that Texas is a Stand Your Ground state, so these CSGV pukes can go jump in a lake. I suggest Lake Michigan at the height of a November Witch.

Warrior, you are correct - but only in regard to reasonable people. The statists will use incidents such as this to 'prove' that individuals are not responsible enough to look out for their own best interests, after all that is the purview of the 'state'. And apparently somewhere around 60 million voters are willing to believe that the state trumps the individual in all cases........

the assailent probably shit his pants while running off, so the CHL holder probably figures that homeboy learned his lesson and doesn't feel compelled to bring the law into it.
