E-mail alert from GunLaws.com: Obama Executive Order Cannot Legally Enact Rifle-Reporting Law

If this stands up, limits on power fall apart -- Is that the true goal of Project Gunrunner?

The effort by the Obama administration to establish new gun law by executive order is not a legal method for enacting law in the United States, according to Alan Korwin, a national expert on gun law and author of nine books on the subject. Other experts agree that such a measure requires an act of Congress, and cannot legitimately be implemented by executive order, as Mr. Obama is attempting to do.

You sound as if you expect "Law Enforcement" to show any concern about this. That does fit your meme. Mine, on the other had, says that they will "bow and scrape before their Masters and then do WHATEVER they are told." Admittedly, this IS BATFE that we are talking about, and that DOES tilt the table in one specific direction...

I agree with Alan. Like a child, Obama has tested to find where the limits are - and no one has stopped him. His administration becomes more bold by the minute. I think they see the risk he will not be re-elected and are going for everything now - and that will include stealing the next election by fraud such as we have never seen. Issa and Grassley had better understand that they need to cut the head off this snake NOW.

More than what AWM asked, WHO is going to stop him? If the SUPREME LAW ENFORCEMENT OFFICER in the republic refuses to be bound by the SUPREME LAW OF THE LAND then who can enforce the law on HIM? More to the point, who has the stones to do so?

Remember, friends nothing is illegal unless you are successfully prosecuted for it.

As Thomas Paine said, "only downright force...." It's a target rich environment. They are not going to stop or even listen, and while gums may flap occasionally with platitudes about freedom and the constitution, they have no intention of ever honoring these things again because they have seized too much power and want to keep it, and more.

Do you think that will bother him? He is already defying Federal Court orders to cease and desist on other fronts. What's an executive order or two when put in that perspective? Jack booting at it's best is on display here.

The US House of representative controls spending (stay with me) by voting the funding through its appropriations committee.

The Executive Order will not be funded.

Congress has 90 days to act on an Executive Order; if Congress elects to do nothing, said order becomes law. According to an article that I read a while back.
But seeing that we have had many sessions of Congress that feed money to the war machine, passing resolutions that give unlimited power to the Executive Branch INCLUDING the power to declare war, being too useless or cowardly to declare war themselves, which is their power alone, according to the Constitution. Oops, I forgot the Constitution is irrelevant!

"Equal treatment under the law would also be defeated by the move..."

Remember, BHO has a law degree and is undoubtedly aware of the illegality of this Executive Order, which seems designed primarily to provoke a confrontation with the House of Representatives and the USSC.

Maybe you could explain how any of the 30,000 or so gun laws are constitutional?
Maybe you could explain what penalties the constitution has for officals who violate the Bill of Rights?

Except they're now in the process of turning control of the so called debt limit over to Obama. At that point the House no longer controls government expenditures.

The Castro Brothers and Chavez must be laughing their behinds off over this one.

How exactly is rule of the United States by executive order any different than rule of the Bolivarian Republic by presidential decree?
