The Pima County Regional SWAT team fired 71 shots in seven seconds at a Tucson man they say pointed a gun at officers serving a search warrant at his home.
Jose Guerena, 26, a former Marine who served in Iraq twice, was holding an AR-15 rifle when he was killed, but he never fired a shot, the Sheriff's Department said Monday after initially saying he had fired on officers during last week's raid.
Six days after Guerena was shot, few details about the investigation that brought the SWAT team to the southwest-side home Guerena shared with his wife and their two young sons are known. Guerena's role in the narcotics investigation is unclear and deputies would not comment on what was seized from his home.
Three other homes within a quarter of a mile from Guerena's house, were served search warrants related to the investigation that morning. The addresses and the names of people who live in the other homes have not been made public.
Vanessa Guerena says she heard noise outside their home about 9 a.m. Thursday and woke her husband who had just gone to bed after working a 12-hour shift at the Asarco Mine, she said. There were no sirens or shouts of "police," she said.
Guerena told his wife and son to hide inside a closet and he grabbed the AR-15 rifle, his wife said.

Those deputies probably thought the AR-15 was one of the GUNWALKER guns that walked back from Mexico. Best advice when hearing a noise outdoors is to look out the window first and if you see "THE LAW" start praying.
More blood, more bodies, no law, no justice.
I can't explain it either. I mean how much time did it take them to recover after pissing themselves when they saw his weapon? And he may have been slow himself, being back in the civilian world, then having put in any number of twelve hour days at work. I know how my wife is after HER sixteen and longer days!
But still a Marine should've been the one left standing, I would think! How many SWATSTERS were actually there?

If someone's at my door and claims to be the cops, they'd best give me time to call 911 to confirm. Otherwise they're going to get shot when they break down my door, because I don't know if they're the police or just some ballsy scumbags yelling "police!" And of course, the no-knock variety of warrant is just an excuse for the police to murder someone: if the house belongs to a gun owner, damn right he's going to shoot at whoever kicked down his door.
The homeowner who was murdered probably realized when they kicked in the door that they were SWAT and didn't shoot, but he was pointing a gun at him so they lit him up.
Why don't cops with a search warrant just knock on the door like a civilized person would? I mean, seriously, WTF! Jackbooted thugs, indeed!

A computer check on Guerena revealed a couple of traffic tickets and no criminal history.
Guerena was a Tucson native and Flowing Wells High School graduate. He joined the U.S. Marines in 2002. He served two tours in Iraq in 2003 and 2005 as part of the Yuma-based MWSS-173 under direct supervision of Master Sgt. Leo Verdugo.
Verdugo was with Guerena's family Tuesday afternoon. He gave them a Marine Corps jacket and gloves to use at Guerena's burial.
"He was an excellent Marine, with a bright future ahead of him," Verdugo said.
"We had just bought a home and he was working graveyard shifts and overtime just to help pay the bills, we were just starting to make this house our home," Vanessa Guerena said.
"I know I can't have him back but I want justice. I want explanations for what happened," she said.

It sounds like Jose was set up by a rat (paid confidential informant) who knew his address and name. Someone at work or a neighbor in the complex? No drugs, drug accessories, etc. were found, but the cops on the scene knew that holding an AR-15 in your own living room is sufficient proof of guilt. Got Kevlar?
Yeah, it looks like a good man was cut down in his home by the Only Ones defenders of Pima, then allowed to die without aid on his living room carpet.
If the widow gets 30% of the SWAT unit budget as hush & go-away money, it won't be enough.
On the surface it looks like another no-knock raid gone bad. I wouldn't doubt if this turned out to be another case of a wrong address. What a tragedy. That's what happens when law enforcement violates the 4th amendment. Eventually they will run into the wrong person and some LEO's will end up being killed.
That said, what can we learn from this incident when it comes to home defense?
SOP for a bunch of overcompensating, jack-booted, type A's who hide behind their shield's. The only thing these SF wannabe's "serve and protect", are their ego's. Professional LEO's do not shoot 71 rounds at 1 person,(armed or not), this is the conduct of gangsta's and thug's.
All I can say is, this had guy had better be Tony Montana, because if this was a case of mistaken identity/wrong house...

Alex Jones and David Codrea have both stated that they receive hundreds of e-mails daily telling of no knock entries, injury and death at the hands of LEO's.

Just another murder by cops. We all know what needs to be done, but few will do it.
If a Marine had lifted his rifle with any intent, the world would be rid of about a dozen pig anuses, aka 'Twat team' cops, and the air we breathe would be a little nicer.
I used to think that the OK would help stop this 'us vs them' thing but it seems the pigs want it... they regularly do everything they can to paint targets on the chest and back of every brother pig in the nation. So if the stuff goes down, most of my associates will not stop to ask for a secret OK handshake; if it wears a uniform it will be assumed to be an armed and dangerous minion of the State and a target of opportunity.

Defense against SWAT wanna-bes? A stout door and frame that requires much more than a a few 12ga blasts or a strong boot-kick to open/break will buy you the few seconds needed.
A flanking maneuver or rapid backdoor exit, depending on if this is the hill you want to keep/win.

I think what happened was he recognized they were SWAT and didn't fire, but they didn't show similar self-control. 71 shots ... how many actually hit him? I also suspect they let him bleed out on the floor so there would only be one side of the story. The wife of a dead Iraq war veteran doesn't play in the press as bad as a wounded Iraq War veteran standing up in front of the cameras.

When I first read the story as it broke, my initial reaction was "one less gangbanger in the world."
Then I read the first followup story: "rifle never fired, safety was on." Reaction was "OK, one less dumbass gangbanger in the world."
Then the latest story comes out, that the guy was a honorably discharged Marine Iraq vet with no criminal record (traffic tickets don't count), and that his Marine superior PERSONALLY delivers a fresh uniform for him too be buried in.
If the guy was dirty, the man who commanded him in battle would damn well NOT be delivering a uniform to him!
WTF is going on with the PCSD? Usually they don't screw up like this, but it really sounds like they fucked up by the numbers here.

Yep, gross overreaction.
Simply put, MURDER by cop. They even had the audacity to lie about Mr. G firing when in fact he did not. There should be charges, but there probably won't be. Some should lose their jobs, but they'll probably get a promotion or a medal.
What about his wife and kids? What the heck are they going to do now that the breadwinner has been needlessly murdered by cops?
And cops wonder why the population they supposedly serve either doesn't trust them or just plain hates them.
Cops like that deserve whatever justice G_d portions to them. Personally, I have no mercy for such a blatant screw up.
Yet another reason the war on drugs needs to be stopped. It's failed miserably. Time for a real change. How many more times does it take before this country gets it and makes the change?

The problem is: the media is complicit and the law covers its own ass. No one investigates whether or not this guy actually was involved in a 'drug ring'. If he wasn't selling the drugs.....that's even worse. If someone owns their own body....it's no business of mine or the government's what they put in it. If someone else owns you.....then doesn't make you his slave?

I don't know if this will be posted or not, but here goes:

Although I am a former police officer, the frequency with which good citizens are killed by SWAT responses leaves _me_ burning. (Remember Eric Scott?)
These days, with excellent body armor, many of these SWAT types are more difficult to service. Head shots are tough - small, very mobile target, and I suspect on some of these swaggering macho types it would only be a flesh wound. What if all of us decided on a particular response of our own? What if we decided that - faced with death by SWAT team - we would concentrate our .308 or 12ga slug/OO fire upon the reproductive equipment of these individuals?
It would serve at least two purposes: 1) if successful, they would not be able to pass on their defective genetic material to the gene pool. 2) Knowing that it had become customary for FreeFor to target then in this manner, some of them might choose a different occupation, or at least hang up their SWAT doo-rags. Perhaps a few fractured pelvises, emptied femoral arteries, or survivors who had to learn to pee into a bag would encourage them to stop assaulting citizens in their own homes.
There are indeed still some good cops out there. However, they are becoming fewer, and you won't find many on a SWAT team. I can't speak for anyone else, but I am quite likely to take my own advice when it comes to SWAT, whether local or Federal.
