There was prosecutorial misconduct here. If I was the photographer, I'd sue and demand any documentation that proved the prosecutor engaged in misconduct. Also, I'd try anything to keep the story in the news, always in a bad light for the Sheriff. By allowing his deputy to attempt to get away with a bullshit charge, he has shown himself to be a verifiable pus bucket. I know I am painting with a broad brush, to say that the majority of Leo's are shitbags, but, if a "good officer" remains silent, when he/she knows of wrong doing within a department, he/she is also a shitbag. The word "honor", among Leo's, at all levels, Fed, state and local, is archaic and mostly relegated to history books. Want respect? Earn it!
The right of jurors to acquit is the ultimate way to fight tyranny without violence. If you're a juror on a criminal case, don't believe the judge's instructions when he tells you if a defendant did not obey the law you must convict. If you view the law as unconstitutional or that it is unjustly applied in this case, you do indeed have the right to acquit.
Smart / informed jury members are indeed a powerful tool to beat back legislative and judicial misprision but there is another toll often not used.
Take that friggin stand AND defend yourself openly in court. Act as your own council alongside retaining co council to beat the system on the " process and form " front.
Remember, a jury cannot nullify if not given a good reason to do so. Interesting how LAWYERS never want people taking the stand,huh?
