The arrogance of this lawless agency is breathtaking. Think for a minute, the complete lack of moral values, of someone wanting to join such an agency, given their history. Yet, scum bag Americans, both male and female, apply every day. Even more appalling, is the lack of interest in the Congress, to rein in, or abolish, this gang of domestic terrorists. When this assault on our rights finally goes south, members of Congress, will be sitting around scratching their balls,(the four or five that have any) wondering how it could have happened. We need to mobilize and flood congress with letters demanding action. Do not let your congressman cop out by telling you about Issa's committee. Preempt this by telling him/her that Issa is a double talking scab.

All the silly legal games are starting to bore me. When will people learn that the laws are for the peons, not the rulers? There is no avoiding a fight. It is too late now.

As Ken at Popehat once said, "Federal judges always really mean it." I don't expect this to go well for the ATF. A magistrate judge does not "outrank" a Real Deal Article III judge. This is serious, serious overreach from the ATF, not matter what fairy tales the US Atty's office was telling them about precedent and "the law" and all of that. At the end of the day, an Article III judge (one of whom in fact this case will have to be heard in front of) was ignored and flaunted, and that will come back to haunt the ATF.

My prediction? An order gets entered ordering the ATF to return everything, destroy all records regarding the investigation, and the exclusionary rule applied to any evidence even tangentially related to the records seized.

I think at the end of the day, the ATF will consider itself lucky if the agent that entered the affidavit isn't referred for perjury prosecution by the Article III judge.
