At least this time no innocent person was harmed. Although I notice the LawVermin are still going after the guy for the non-crimes of having plants and a gun. I hope jury nullification comes into play. I also hope someone gives the guy a medal for ridding the world of one thug.

Dick DeGuerin, who along with another attorney named Zimmerman, got the Branch Dividians acquitted of murder charges. Looks like he still has the juice. These no knock raids are nothing more than bad tactics, begging for things to end badly. Will any of it change? Nope. Among law enforcement, no knock raids are part of the militarized culture. They cannot see the parallels of their behavior with that of the former KGB. No problem; maybe the paycheck is worth the risks.

Interesting on how something that is legal in some states can get someone killed in another.

Interesting quote.... "The Burleson County Sheriff's Office would not have been there that day if Mr. Magee had not decided to live a lifestyle of doing and producing illegal drugs in his home. Therefore, we will fully prosecute the drug charges against him."

So, they are still going to try and nail his balls to the wall.

Interesting quote #2...."It need not have happened. They could have walked up to his house in the daylight and he would have let him in or they could have stopped him as he left his house to go to the store," said DeGuerin.

I guess the one thing we can take from this is that "Note to all you nighttime door bashers, Unintended Consequences are a bitch."

I think we should all take notice that he was not indited on any charges for shooting the (I'm assuming, masked) thugs that broke into his home.

The power to no knock raid your house over a pot plant is the same power to no knock raid your house over a tomato plant.

Notice please, that it's the plant factor presenting the problem more than the no knocking. Let's say it's known that a freak has three little girls kidnapped and realistically the best way to save them is to crash the house AHEM absent a cordial knock. Now imagine one of those girls is your daughter. Still wanna play like it's about the knocking and lack of it? I thought not.

Banning no knocks isn't the answer. LIMITING IT is. First, and most obvious, there MUST be a WARRANT prior and second is that said warrant MUST contain the enumerated power being exercised. In this case, we must ask and see answered the following -

Just what authority over a plant is being exercised here? Go ahead and say "interstate commerce". I dare ya. Lolz.

I wonder how many cops wanna die over that TALL bullshit ? Pay attention, boiled down to the nitty gritty, they are gonna have to answer the SAME way were they going after guns instead of plants. I'll ask the same question then too?

How many cops wanna get shot and killed over the "interstate commerce" fabrication?

Well, at least that grand jury did half its duty.

They appear to have disregarded their duty to examine the law and its application, and failed to observe the Unconstitutionality of cannabis prohibition as well as the inherent ridiculousness of criminalizing the cultivation...of a plant.

To no bill the murder charge but to indict for the silly-ass manufactured crime of growing a plant (one wonders what Thomas Jefferson would think...) ???

Had schizophrenia got hold of those jurors, or was the orchestra conductor (aka government prosecutor) merely off his game that day?

Let's hope for a proper outcome at trial regarding the "producing of illegal drugs". Acquittal.

Isn't the same federal government that initiated this nutty prohibition scheme responsible for surreptitiously dosing people with LSD and the like during the CIA's MK Ultra mind control experiments?

“The events on December 19, 2013 are tragic. In my opinion, the Burleson County Sheriff’s Office did nothing illegal by securing and executing a “no knock” search warrant that day. I believe the evidence also shows that an announcement was made. However, there is not enough evidence that Mr. Magee knew that day that Peace Officers were entering his home. The events occurred in a matter of seconds amongst chaos. The self-defense laws in Texas are viewed in the mindset of the actor, not the victim, which allows for tragedies to occur when one party is acting lawfully, but it can be reasonably seen as a threat of deadly force by another. However, the Burleson County Sheriff’s Office would not have been there that day if Mr. Magee had not decided to live a lifestyle of doing and producing illegal drugs in his home. Therefore, we will fully prosecute the drug charges against him. This event should wake the community up that drug crimes are not victimless.”

The DA's words mirror the insane Gestapo militarized mentality of the War on *some* drugs.

Too bad the dude didn't off the entire SWAT team-ya know those f-ers are gonna be more apt to be trigger happy in subsequent military raids.

Our ancestors wouldn't tolerate this crap...
