He really needs to get his story straight. Does he think he should have them or not? After all, as much as it might bother him, HE is a civilian too. Despite what he and the rest of the thugs with badges think, all LEOs are civilians. They are no different than anyone else and should have to abide by the same rules and limitations.
The argument is being framed as being about "need" not constitutionality of the statute. The plaintiffs have already lost since the defendants have control of the arguments.
The 2nd Amendment is only peripherally about personal defense. It is about nothing less than the defense of liberty itself. That is why the prefatory clause references the security of a free state. The 2nd amendment is solely geared towards ensuring that a militia can properly function. Personal defense and sporting arms are not primarily what is protected. Without military grade arms - and I do not believe that it is limited to "small" arms - no army can possibly function properly. If the right of the people to acquire and carry military grade arms is compromised then no militia could possibly be said to function properly. The 2nd amendment was fundamentally - and fatally - compromised when the National Firearms Act was passed some 80 years ago. By effectively limiting "civilians" to semi-automatic arms the NFA instantly made it impossible for any militia to properly function. Everything else done in the area of so-called "gun control" has merely added insult to injury.
Cops also have backup, radios, dispatch, and plenty of help from people with assault rifles and sometimes even tanks whenever they need it. Unlike mere mundanes, they will arrive very quickly, too.
If anyone doesn't "need" standard capacity mags, it is the police. The civilians will almost always be outnumbered and the element of surprise going against them. So they actually need as much ammo as they can get.

How's this: I see no need for cops, retired or otherwise, to be armed in the first place. Most of them can't shoot worth a darn anyway. I read once that the most stressful period in the average cop's career is the 30 days before requalification.
Firearms are required to maintain the individual's "state" of being free - not as is currently interpreted to keep the State, a political entity, somehow 'free'.
Note the difference and think back on the state of mind of the Founding Fathers...
It is right hat civilians don't need giant magazines if they are using guns for safety purpose or for target shooting. Illegals gun supply and manufacturing should be control because criminals obtain their guns illegally. The black market aids criminals in this. Criminals don't bother about gun control laws.
